Filing Sealed Documents (for attorneys)

Sealed Motions
You must refer back to an Order, Minute Entry or Motion approving or requesting to file the document under seal. If you do not refer back to an Order, Minute Entry or to a pending Motion to Seal document, you will not be able to continue filing. You must serve this document by conventional method.

  • Under Civil or Criminal Motions, select Sealed Motion.
  • Under Available Events, select Sealed Motion.
  • Attach your PDF document.
     

Ex-Parte Sealed Motions
You must serve this document by conventional method.

  • Under Civil or Criminal Motions, select Sealed Motion.
  • Under Available Events, select Ex-Parte Sealed Motion.
  • Attach your PDF document and complete the transaction.
     

Sealed Documents
You must refer back to an Order, Minute Entry or Motion approving or requesting to file the document under seal. If you do not refer back to an Order, Minute Entry or to a pending Motion to Seal document, you will not able to continue filing. You must serve this document by conventional method.

  • Under Civil or Criminal Other Filings, select Sealed Documents.
  • Under Available Events, select Sealed Document.
  • Attach your PDF document.

     

Ex-Parte Sealed Documents
You must serve this document by conventional method.

  • Under Civil or Criminal Other Filings, select Sealed Documents.
  • Under Available Events, select Ex-Parte Sealed Document.
  • Attach your PDF document and complete the transaction.

     

Messages in Sealed Events
During sealed events (non ex-parte) you will encounter the following question:"Is there a Motion, Order or Minute Entry requesting or approving this filing under seal"? By answering "Yes" you will affirm that you have permission from the court to file, or that you have filed a Motion to Seal Document that is pending. By answering "No" you will receive this message: "You cannot file this document under seal without a related Order or Minute Entry, or without filing a Motion to Seal Document." 
 

 

Adding Corporate Parents and/or Other Affiliates

  • Choose "Corporate Disclosure Statement" from the Available Events menu.
  • Click Browser under Main Document and locate on your computer the PDF version of the Corporate Disclosure Statement you wish to file. With the file name highlighted, click Open.  Your document will appear in the Main Document textbox. Click Next.
  • Select the filer.  (The party you represent that is filing the document.)
  • You are prompted to add the corporate parent and/or affiliates.  Click Next.
  • Search for a corporate parent or other affiliate by entering the name.  Click Search.
  • Select the name from the search results, or select Create New if it is not on the results list.
  • Select a description under Type, and click Add corporate parent or other affiliate
  • Select the party associated with the Corporate Parent or Affiliate and click Next.
  • You are returned to the Search screen, where you can add another corporate parent or affiliate.  Repeat Steps 1-5. 
  • Click the  "End corporate parent or other affiliate selection"  button when you are finished adding your corporate parents or affiliates, OR when you have none to add.  Selecting "End" will enable you to continue on to the docket text screen and finish the transaction.

 

 Filing a Civil Motion

  • Select "Civil" from the ECF blue menu bar, then choose "Motions" in the "Motions and Related Filings" category.
  • Enter the case number and select Find This Case.
  • Choose the type of motion from the Available Events menu.
  • Select the filer. (The party or parties you represent.) (Hint:  to select more than one party, hold down the CTRL key and click with your mouse.)
  • Under Main Document, click Browse, search for the PDF of the motion, and select it to upload to ECF. 
  • Under Attachments, click Browse, search for the PDF of the proposed order, and select it to upload to ECF. Name it under Category, Description, or both.
  • Indicate Oral Argument, if requested on the motion.
  • Enter the noting date for the motion.
  • On the docket text screen, choose a modifer to further describe the filing if needed,
  • On the Final Text screen, Click Next to commit the transaction. 
  • View, save, or print the Notice of Electronic Filing. This is your receipt, and lists all those who received the document via electronic service and those who must be served by conventional means. Note: Sealed documents are not served electronically.
  • You will also receive a Notice of Electronic Filing in your e-mail.  You may view the document image once without charge by clicking on the document number in the e-mail notice.
  • After logging out of the ECF system, send an email to the judge attaching the proposed order in Word or WordPerfect format. 
  • The format of the email address is: [JudgeLastName]Orders@wawd.uscourts.gov. For example: PechmanOrders@wawd.uscourts.gov. Remember to put the case number and name of the proposed order in the subject line of the e-mail.

     

Filing a Declaration (Civil or Criminal)
Each declaration is a separate filing with its own document number, whether in support of a motion, response or reply.  It needs to be easily located on the docket. Each declaration will be linked back to the motion, even if the declaration is filed with the response or reply.

  • Select "Civil"  or "Criminal" from the ECF blue menu bar, then choose "Declarations" in the "Reponses, Replies and Supporting Documents" category.
  • Select the filer.
  • Under Main Document, click Browse, search for the PDF of the declaration, and select it to upload to ECF.
  • If you have separate exhibits, click Browse under Attachments, and follow the same steps.  Keep in mind the 5 MB limit per PDF.  Exhibits that are too large will need to be split into 5 MB segments.
  • Name the exhibits using the category, description, or both. Remember, ECF chooses from the category first, then the description.  
  • If you have voluminous exhibits, you should not attempt to file them all in the same transaction. This may cause the system to time out and you won't be able to complete your filing.  File the rest of your exhibits using "Exhibit" under Other Documents, where you will be able to name them as you go.
  • On the final text screen, click Next to commit the transaction.
  • View, save, or print the Notice of Electronic Filing. The receipt lists all those who received the document via electronic service and those who must be served by conventional means.  Note: Sealed documents are not served electronically. 
  • You will also receive a Notice of Electronic Filing in your email.  You may view the document image once without charge by clicking on the document number in the email notice.

 

Filing a Criminal Motion

  • Select  "Criminal" from the ECF blue menu bar, then choose "Motions" in the "Motions and Related Filings" category.
  • Enter the case number and select "Find This Case".
  • Important:  Choose the defendant's case this filing pertains to. (In a multi-defendant case, choosing "all defendants" may adversely affect speedy trial settings for the case.)
  • Choose the type of motion under Available Events.
  • Select your client as the filer.
  • Under Main Document, click Browse, search for the PDF of the motion, and select it to upload to ECF.
  • Under Attachments, click Browse, search for the PDF of the proposed order, and select it to upload to ECF. Name the attachment under Category, Description, or both.
  • Indicate Oral Argument, if requested on the motion.
  • Enter the noting date.
  • On the docket text screen, choose a modifer to further describe the filing, if needed.
  • On the Final Text screen, click Next to commit the transaction.
  • View, save, or print the Notice of Electronic Filing. The receipt lists all those who received the document via electronic service and those who must be served by conventional means. Note: SEALED documents are not served electronically.
  • You will also receive a Notice of Electronic Filing in your e-mail.  You may view the document image once without charge by clicking on the document number in the e-mail notice.
  • After logging out of the ECF system, send an email to the judge attaching the proposed order in Word or WordPerfect format.    
  • The format of the email address is: [JudgeLastName]Orders@wawd.uscourts.gov. For example: PechmanOrders@wawd.uscourts.gov. Remember to put the case number and name of the proposed order in the subject line of the email.

 

 Filing a Notice of Joinder in a Criminal Case

  • Select "Criminal" from the ECF blue menu bar, then choose "Notices" in the "Other Filings" category.
  • Enter the case number and select Find This Case.
  • Important:  Choose both your client's case number and the case number of the defendant whose motion you wish to join. 
  • Select Notice of Joinder from the Available Events menu.
  • Select your client as the filer.
  • Under Main Document, click Browse, search for the PDF of the notice, and select it to upload it to ECF.
  • Select the other defendants motion from the selection list.
  • On the final text screen, click Next to commit the transaction.
  • View, save, or print the Notice of Electronic Filing. The receipt lists all those who received the document via electronic service and those who must be served by conventional means. Note: Sealed documents are not served electronically.
  • You will also receive a Notice of Electronic Filing in your e-mail.  You may view the document image once without charge by clicking on the document number in the e-mail notice.

   Filing a Non-PDF item (Such as a DVD or Audio CD)

  • Select "Civil" or "Criminal" from the ECF blue menu bar, then select 'Notices' under Other Filings.
  • Enter the case number and select Find This Case.
  • Select 'Notice of Filing Paper or Physical Materials with the Clerk' under the Available Events menu.
  • Under Main Document, click Browse, search for the PDF of the notice and select it to upload it to ECF. (Either create your own or use the form on the Court's website)
  • Select your client as the filer.
  • Describe the non-PDF item.
  • Enter through the rest of the transaction and submit it to the Court.
  • Deliver the non-PDF item with a copy of the e-filed Notice to the Clerk's Office.
