A settlement has been reached in this lawsuit in which plaintiffs Frank “Joe” Mendez, Sia Gould, and Donald Max Kimball (collectively “Plaintiffs”) allege that defendants Steelscape, LLC and Steelscape Washington, LLC (together “Steelscape”) failed to pay wages related to a fiscal-year-end bonus compensation under Steelscape’s bonus plan(s) applicable to production employees during Fiscal Years 2017 and/or 2018. Plaintiffs allege that they and other production employees earned bonus compensation under those plans that was not paid by Steelscape due to alleged unlawful changes to the terms of the bonus plans.
A hearing has been scheduled for February 22, 2022, at 10:00 a.m. before the Honorable Thomas S. Zilly. At the hearing, the Court will determine whether the proposed class action settlement should be approved.
The hearing will be conducted remotely via the ZoomGov.com platform. A link for the ZoomGov.com session, as well as the meeting identification (“ID”) number and passcode, will be provided via email to all counsel and to the Settlement Administrator. The named parties and any class member may participate in the ZoomGov.com session by obtaining the link and/or the meeting ID number and passcode from counsel or from the Settlement Administrator. The Class consists of all current and former employees of Steelscape who were employed in production positions at Steelscape’s facility in Kalama, Washington, between July 1, 2016 and June 30, 2018, and who received a fiscal-year-end bonus for Fiscal Year 2017 or Fiscal Year 2018 under Steelscape’s bonus opportunities applicable to Kalama production employees. Class Counsel has filed a Motion for Attorney Fees, Costs, and Enhancement Awards. Any response to the motion by a class member who is represented by counsel must be filed with the Court by February 7, 2022. Any response to the motion by a class member who is not represented by counsel must be submitted to Class Counsel and postmarked by January 31, 2022. Class Counsel shall collate and file as an attachment to any reply, all responses from class members who are not represented by counsel. Any reply shall be filed by February 11, 2022, but no reply need be filed if no response is filed with the Court or received by Class Counsel.
