Guidance re: discovery disputes in civil litigation
In civil cases with discovery issues, Judge Fricke encourages the parties to identify the earliest point for informal resolution of unresolved discovery disputes.
In some situations, a discovery status conference is the best way to resolve the impasse. When counsel consider whether to file a motion to compel or a motion for protective order, they should contact the Deputy Clerk of Court and request a pretrial discovery status conference under FRCP 16(a), FRCP 16(c)(2)(F) and LCR 16 (c), (m)(4). Judge Fricke may decide to schedule a Zoom hearing, on the record, and ask the parties to file a joint status report, when they reach impasse in a discovery dispute. This would occur after the meet-and-confer process results in impasse but before any motion to compel or motion for protective order is filed.
